Petitioner is languishing in custody since 03.01.2012 in a case registered for the offences punishable under Sections 302/34 of the I.P.C.

Accusation is of killing the daughter of the informant after 17 years of marriage.

It is submitted by learned counsel for the petitioner that the victim died due to the accidental fire. Though, it is submitted by learned A.P.P. that the son of the victim suggested that the petitioner used to torture the victim.

Considering the fact that there is no eye witness to the occurrence when the victim died after 17 years of marriage, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Adhoc Additional Sessions Judge-Vth at Aurangabad in 2 Patna High Court Cr.Misc. No.4426 of 2013 (6) dt.17-06-2013 2/2 connection with Sessions Trial No. 205A of 2012, arising out of Kutumba P.S. Case No. 02 of 2012.

Learned Trial Court will be at liberty to cancel the bail bonds of the petitioner, if the petitioner defaults for three consecutive occasions.
