Matter is heard through Video Conferencing.

The applicant has filed this third bail application u/S.439 Cr.P.C for grant of bail. Applicant has been arrested on 29.12.2020 by Police Station Joura, District Morena in connection with Crime No.867/2020 registered for offence under Sections 354, 323, 506, 34 of IPC and 7/8 of POCSO Act. His earlier bail applications were dismissed as withdrawn by this Court.

It is the submission of learned counsel for the applicant that applicant is suffering confinement since 29.12.2021 and by now material prosecution witnesses (prosecutrix) have been examined on 28.06.2021 and she referred the name of one Veeru Gandhi who committed the act of offence under Section 354 of IPC and Section 7/8 of POCSO Act. Surprisingly, Veeru Gandhi got bail within seven days on 05.01.2021 itself and applicant is 2 languishing in jail for last six months. Now he learnt the lesson hard way and would mend his ways and would not involve in any criminal activity in future specially in such activity related to offence against women. He undertakes not to be a source of embarrassment and harassment to the prosecutrix in any manner and would not move in her vicinity. Applicant further undertakes to perform community service by way of plantation to purge his misdeed and to serve national/environmental/social cause. Under these grounds, he prayed for grant of bail to the applicant.

Counsel for the State opposed the prayer and submitted that looking to his criminal record of 5 cases and the nature of allegations, his bail may be dismissed and if granted, then stringent conditions may be imposed over him, specially that he may not commit same nature of offence in future.

Heard learned counsel for the parties at length through VC and considered the arguments advanced by them.

Considering the submissions specially the period of custody and the fact that material prosecution witnesses have been examined therefore, as per the spirit echoed in the order of Sunita Gandharva Vs. State of M.P. reported in 2020 (3) MPLJ(Cri.)247 and especially looking to the mandate of Apex 3 Court in the case of Aparna Bhat Vs. State of M.P. reported in 2021 SCC Online 230, this Court intends to allow the present application but with certain stringent conditions specially the condition of community service so that applicant may have a chance to reform himself and not indulge in criminal activities therefore, it is hereby directed that the applicant shall be released on bail on his furnishing personal bond of Rs.50,000/- (Rupees Fifty Thousand only) with two solvent sureties of Rs.50,000/-

to the satisfaction of trial Court.

This order will remain operative subject to compliance of the following conditions by the applicant:-

1. The applicant will comply with all the terms and conditions of the bond executed by him;
2. The applicant will cooperate in the investigation/trial, as the case may be;
3. The applicant will not indulge himself in extending inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the Court or to the Police Officer, as the case may be;
4. The applicant shall not commit an offence similar to the offence of which he is accused;

5. The applicant shall regular appear in the trial Court and shall not seek unnecessary adjournments during the trial; and;
6. The applicant will not leave India without previous permission of the trial Court/Investigating Officer, as the case may be.
7. Applicant shall not involve in such activity related to offence against women and if any threat or intimidation is given to the complainant party, then they shall be at liberty to file complaint before the concerned police station or make an application for cancellation of bail.
8. The Station House Officer of the concerned Police Station is directed as follows:-
1. The Station House Officer shall inform the victim about the release of the petitioner/appellant on bail and shall also supply a copy of this bail order to the victim.
2. In case of breach of any of the conditions of this order, the victim shall be free to report the matter to the Station House Officer of the concerned Police Station.
3. On receipt of any such complaint from the victim, the Station House Officer of the concerned police station, in turn, shall inform the Registry of this Court.
4. On receipt of information from the Station House Officer as aforesaid, the Registry of this Court shall list this matter under caption "Directions" before the 5 appropriate Bench.
