CMP No. 713 of 2023 in FAO (MVA) No. 8 of 2020 sought By way of present application, the applicants, Inderjeet Singh and Gurpreet Kaur, have release of the amount of compensation, which was awarded to them by the learned MACT, Solan, vide award dated 4.10.2019, titled as, 'Inderjeet Singh & another versus Shiv Kumar & another'.
The Insurance Company has assailed the said award, by way of FAO(MVA) No. 8 of 2020, titled as, 'New India Assurance Company Limited versus Inderjeet Singh and others'. The said FAO(MVA) has been dismissed by this Court, vide judgment dated 23.12.2022.
As per the report of the Registry, a sum of Rs. 48,32,288/ has been deposited by the Insurance Company. The learned MACT, Solan has apportioned the award amount between the applicants, in equal shares.

has stated that he has no objection in case 50% of the award amount is released in favour of the applicants.
In view of this, the present application is allowed and 50% of the award amount, falling to the shares of the applicants, is ordered to be released in their favour, alongwith proportionate interest. The amount, so released, is directed to be remitted to the bank account of the applicants, particulars of which have been mentioned in para5 of the application. The application is disposed of.
