Ld. Counsel for the Respondents requested for two more weeks time to file objection to the petition for condonation of delay. Time was allowed vide order dated 03.12.2018 and 18.12.2018. In spite of that no objection was filed. It is seen that the matter pertains to stepping up pay compared to the juniors of the applicant who are getting higher pay. We are of the view that this is a continuing cause of action, and therefore, M.A. No.376/2018 filed for condonation of delay is allowed. M.A. Nos.48/19 and 436/18 filed by the Respondents for time to file objection/reply to condonation of delay are disposed of accordingly.
Ld. Counsel for the applicant submitted that as per Annexure-A/9 dated 17.10.2016 the matter is again being taken up with the Cabinet Secretariat and the decision is awaited.
In view of the submissions of the Ld. Counsel as above, and taking into consideration that the grievance of the applicant is pending as indicated in letter dated 17.10.2016 (Annexure-A/9), the Respondents are directed to take a decision in pursuance of the said letter by passing a speaking and reasoned order, copy of which shall be communicated to the applicant within two month from the date of receipt of copy of this order.
Accordingly, the O.A. is disposed of. No costs.
