Facts:
1. Shri Madan Mohan Tewari submitted RTI application dated 10 August 2009 before the CPIO, office of the Chief Commissioner of Income Tax, UP (West) Region, Kanpur seeking information regarding details of month wise vacancies for the period January 2000 - December 2001 considered by DPC held on 10 July 2001 for promotion of stenographer grade III to stenographer grade II.
2. Vide CPIO order dated 17 August 2009 appellant was informed that the information in which manner, it has been sought for, was not available in the office. However vacancy position for the recruitment years 1999 - 2000 and 2000 - 01 was provided.
3. Applicant preferred appeal dated 27 August 2009 before the first appellate authority. Matter was decided vide FAA order dated 15 September 2009 by concurring with the order of the CPIO.
4. Applicant preferred second appeal before the Commission. The matter was heard today through videoconferencing. Respondent was present and heard from Kanpur. Appellant presented arguments from Lucknow.

5. After hearing both sides Commission directs respondent to provide information as to whether the fact that they were 26 vacancies during the recruitment year 2000 - 2001 was put up before the members of the DPC at its meeting on 10 July 2001.
6. Information as above to be provided within two weeks of receipt of the order.
