The petitioner has been in custody w.e.f. 19.08.2012 for having been found in possession of 5 Kgs of opium.

Learned counsel for the petitioner submits that no witness has been examined till date.

It has been informed by the learned State counsel that the petitioner is involved in one another case under the NDPS Act.

I do not find any ground for grant of concession of regular bail to the petitioner at this stage.

Dismissed.

However, in the interest of justice a direction is issued that prosecution will examine all the prosecutions witnesses within a Sunder Sham 2014.03.20 15:44 I attest to the accuracy and integrity of this document Chandigarh CRM No. M-9098 of 2014 -2 - period of six months after the next date of hearing before the trial Court. In case the prosecution agency fails to produce all the prosecution witnesses within a period of six months, the trial Court shall release the petitioner on bail on his furnishing bail bonds/surety bonds to the satisfaction of the trial Court.
