% 14.10.2022 Notice on this petition was issued on 26.08.2021. As the record shows, there was no appearance on behalf of the peti- tioner on 22.02.2022 and 06.07.2022.

Order dated 16.11.2021 records that the process fee filed for service upon the respondent, was returned under office objections.

Thereafter no steps have been taken by the petitioner for service. To- day Mr. Manu Garg, learned counsel who appears on behalf of the petitioner, submits that he had filed process fee; however, the office report indicates that the process fee is yet again lying under Registry objections.

Evidently, the petitioner has been repeatedly negligent in prosecuting the matter.

Vide order dated 19.05.2022 made in SLP(C) No. 5306/2022 titled M/s Shree Vishnu Constructions vs. Engineer in Chief, Military Engineer- ing Services & Ors the Hon'ble Supreme Court has directed that petitions Signature Not Verified Digitally Signed By:NEERAJ Signing Date:18.10.2022 ARB.P. 816/2021 Page 1 of 2 11:35:15 under section 11 of the Arbitration & Conciliation Act, 1996 which are pending for more than one year from the date of filing, must be decided within 06 months.

In the above view of the matter, the present petition is dismissed for non-prosecution.

Pending applications, if any, also stand disposed of.
