Heard learned counsel for the petitioner. Sri Lalit Shukla, learned counsel for the respondent no. 3. Learned Standing Counsel appearing on behalf of respondent no. 2.

The present petition has been filed claiming indulgence of the Hon'ble Court with the pleadings that the petitioner is a farmer and has been earning his livelihood through agriculture. The petitioner has applied for a loan in the year 2012, however, on account of certain personal exigencies and crop failure, the aforesaid amount could not be repaid as a result the opposite parties have issued a recovery certificate for a sum of Rs. 11,63,691/- and now it is prayed that the aforesaid sum may be permitted to be deposited in easy installments as the petitioner is ready for the same.

Sri Lalit Shukla, learned counsel for the opposite party no.3-Bank submits that he has no objection in case the petitioner deposits the aforesaid amount in installments.

Considering the above and looking into the facts and circumstances of the case, it is provided that in case if the petitioner deposits a sum of Rs. 3,00,000/- within a period of one month from today and the remaining in 6 quarterly installments along with up to date interest to be paid with the last installment. If the same is done, no coercive action shall be taken against the petitioner. However, in case if the petitioner makes any default, he shall not be entitled to any benefit of this order and the opposite party no. 3 shall be entitled to recover the remaining amount in accordance with law.

With the aforesaid, the petition stands disposed of.
