1. The present petition has been filed under Articles 226/227 of the Constitution of India for issuance of a writ of mandamus directing respondent No.1/punishing authority to stop the recovery @ 60% per month from the salary of the petitioner till the pendency of the statutory appeal dated 26.02.2024 (Annexure P-2) filed by the petitioner against the order of punishment dated 05.01.2024 (Annexure P-1) issued under endorsement No.PWC/E-10/EF - 359/1087 - 1102/24 dated 18.01.2024 passed by respondent No.1, whereby recovery of Rs.24,24,414/- has been imposed on the petitioner. Further direction has been sought to stay the operation of the order dated 05.01.2024 (Annexure P-1) till respondent No.2 decides the Statutory Appeal dated 26.02.2024 (Annexure P-2), filed by the petitioner.

2. Learned counsel for the petitioner at the outset confines his prayer for deciding the appeal dated 26.02.2024 (Annexure P-2) filed by the petitioner expeditiously by passing a speaking order within a time bound frame.

3. Notice of motion.

4. Mr. Mandeep Kumar Advocate for Mr. Jastej Singh, Advocate, who is present in the Court accepts notice on behalf of the respondents and raised no objection to the innocuous prayer made by learned counsel for the petitioner.

5. I have heard learned counsel for the parties and have gone through the record of the case.

6. Without expressing any opinion on the merits of the case or the claim being made by the petitioner in the present petition, the Appellate Authority-respondent No.2 is directed to consider and decide the appeal dated 26.02.2024 (Annexure P-2) in accordance with law, by passing a speaking order as expeditiously as possible preferably within a period of 06 months from the date of receipt of certified copy of this order.

7. Since the statutory appeal is still pending and yet to be decided, it will be in the interest of justice that no further recovery be effected from the petitioner till the disposal of the appeal.

8. The petition stands disposed of.
