The instant Review Application (RA) has been filed by the respondents in OA No. 2186/2022 under Rule 17 of the Central Administrative Tribunal (Procedure) Rules, 1987, thereby seeking review of order dated 04.02.2025 passed by this Tribunal in the aforesaid OA. The captioned MA has been filed seeking condonation of delay of 82 days in filing of the present RA. In such application, it is contended by the applicants that certified copy of the order sought to be reviewed was received by the Review Applicants on 27.02.2025. After considering the said order/judgment, the matter was examined and it was decided to seek legal advice and the same was submitted to their learned counsel. On receipt of the legal opinion, the matter was again examined and it was decided to file the accompanying RA. The consideration of the matter involved checking the records relating to the decision of the Hon'ble Tribunal and relevant records were to be connected. Thus, the RA was filed. It is further submitted that the Review Applicants are a Government Department where decision making process involves consultations at various stages 17 RA No. 125/2025 in OA No. 2186/2022 and such process has taken some time. The delay in filing of the Review Application is neither intentional nor deliberate but due to time taken in administrative process.
2. For the reasons mentioned in the MA, the delay in filing the RA is condoned and the MA is allowed.
3. The captioned RA has been filed on the following grounds:
i) That while disposing of the OA, the Tribunal failed to consider that the upgraded pay scales granted to Accounts Staff in Railways is based on the recommendations of Group of Ministers as approved by the Union Cabinet on 19.02.2003 and has not emanated from the recommendations of the 5th Central Pay Commission
ii) That the Tribunal failed to consider the fact that the Union Cabinet decided to grant upgraded pay scales to the Account Staff of Indian Railways on notional basis from 01.01.1996 and on actual basis prospectively i.e. w.e.f.
19.02.2003 and thus, the grant of improved pay scale to Accounts Staff is based on a conscious recommendation of Group of Ministers and not based on 5th CPC recommendations 18 RA No. 125/2025 in OA No. 2186/2022
iii) That the Tribunal failed to take into consideration the fact that the 5th CPC had examined all aspects which had bearing on the pay scales, in great detail and all sections of staff had been given opportunities to submit their representations/memorandum before the 5th CPC
iv) There is an error apparent on the face of record as the Tribunal failed to appreciate that 5th CPC has not discriminated but taken a conscious decision for not revising pay scale of Senior Auditors as it would have repercussions in other organizations of the Government of India
v) That the Tribunal filed to take into consideration the law laid down in the case of Arun Jyoti Kundu
vi) That the Tribunal failed to appreciate that the 5th CPC took cognizance of the fact that there is an element of direct recruitment of graduates at the level of Junior Account Assistant and made a conscious recommendation for granting normal replacement scale at par with general recommendation for the Accounts Staff in Audit and Accounts Department in view of traditional parity amongst them 19 RA No. 125/2025 in OA No. 2186/2022
vii) That the implementation of higher pay scales to the Accounts staff in Indian Railways, with retrospective effect, would have a chain effect and wide repercussions
viii) That a Review Petition filed vide Diary No. 21709/2025 against the common order dated 09.09.2024 passed by the Hon'ble Supreme Court is pending and are all related to same analogous matters
4. Before dealing with the grounds pleaded in the Review Application, we may advert to the settled law regarding Review jurisdiction in a catena of cases as under:-
(i) The Supreme Court in Lily Thomas v. Union of India, (2000) 6 SCC 224, held:
"The power of review can be exercised for correction of a mistake but not to substitute a view."
(ii) Similarly, in Union of India v. Sandur Manganese & Iron Ores Ltd., (2013) 8 SCC 337, it was reiterated that:
"A review is by no means an appeal in disguise whereby an erroneous decision is reheard and corrected."
(iii) The Hon'ble Supreme Court in the case of S. Madhusudhan Reddy vs. N. Narayana Reddy and others, reported in 2022 LiveLaw (SC) 685, has very elaborately considered the scope of Review, relevant paras of the same are reproduced below:- 20 RA No. 125/2025 in OA No. 2186/2022
"19. After discussing a series of decisions on review jurisdiction in KamleshVerma v. Mayawati and Others (2013) 8 SCC 320, this Court observed that review proceedings have to be strictly confined to the scope and ambit of Order XLVII Rule 1, CPC. As long as the point sought to be raised in the review application has already been dealt with and answered, parties are not entitled to challenge the impugned judgment only because an alternative view is possible. The principles for exercising review jurisdiction were succinctly summarized in the captioned case as below:
"20. Thus, in view of the above, the following grounds of review are maintainable as stipulated by the statute:
20.1. When the review will be maintainable:
(i) Discovery of new and important matter or evidence which, after the exercise ofdue diligence, was not within knowledge of the petitioner or could not be produced by him;
(ii) Mistake or error apparent on the face of the record;
(iii) Any other sufficient reason.
The words "any other sufficient reason" has been interpreted in Chajju Ram vs. Neki, AIR 1922 PC 112, and approved by this Court in Moran Mar BasseliosCatholicos vs. Most Rev. Mar Poulose Athanasius &Ors.,1955 SCR 520 to mean "a reason sufficient on grounds at least analogous to those specified in the rule". The same principles have been reiterated in Union of India v. Sandur Manganese & Iron Ores Ltd. &Ors., 2013) 8 SCC 337.
20.2. When the review will not be maintainable: -
(i) A repetition of old and overruled argument is not enough to reopen concluded adjudications.
(ii) Minor mistakes of inconsequential import.
(iii) Review proceedings cannot be equated with the original hearing of the case.
(iv) Review is not maintainable unless the material error, manifest on the face of the order, undermines its soundness or results in miscarriage of justice.
(v) A review is by no means an appeal in disguise whereby an erroneous decision is re-heard and corrected but lies only for patent error.
(vi) The mere possibility of two views on the subject cannot be a ground for review.21 RA No. 125/2025 in OA No. 2186/2022
(vii) The error apparent on the face of the record should not be an error which has to be fished out and searched.
(viii) The appreciation of evidence on record is fully within the domain of the appellate court, it cannot be permitted to be advanced in the review petition.
(ix) Review is not maintainable when the same relief sought at the time of arguing the main matter had been negatived."
20. In AribamTuleshwar Sharma v. AribamPishak Sharma15, this Court was examining an order passed by the Judicial Commissioner who was reviewing an earlier judgment that went in favour of the appellant, while deciding a review application filed by the respondents therein who took a ground that the predecessor Court had overlooked two important documents that showed that the respondents were in possession of the sites through which the appellant had sought easementary rights to access his home-stead. The said appeal was allowed by this Court with the following observations:
"3 ...It is true as observed by this Court in Shivdeo Singh and Others v. State of Punjab, (1979) 4 SCC 389,there is nothing in Article 226 of the Constitution to preclude a High Court from exercising the power of review which inheres in every court of plenary jurisdiction to prevent miscarriage of justice or to correct grave and pulpable errors committed by it. But, there are definitive limits to the exercise of the power of review. The power of review may be exercised on the discovery of new and important matter or evidence which, after the exercise of due diligence was not within the knowledge of the person seeking the review or could not be produced by him at the time when the order was made; it may be exercised where some mistake or error apparent on the face of the record is found; it may also be exercised on any analogous ground. But, it may not be exercised on the ground that the decision was erroneous on merits. That would be the province of a court of appeal. A power of review is not to be confused with appellate power which may enable an appellate court to correct all manner of errors committed by the subordinate court."
(emphasis added)
21. In State of West Bengal and Others v. Kamal Sengupta and Another27 , this Court emphasized the requirement of the review petitioner who approaches a Court on the ground of discovery of a new matter or evidence, to demonstrate that the same was not within his knowledge and held thus:
"21. At this stage it is apposite to observe that where a review is sought on the ground of discovery of new matter or evidence, such matter or evidence must be relevant and must be of such a character that if the same had been produced, it might have altered the judgment. In other words, mere discovery of new or important matter or evidence is not sufficient ground for review ex debito justitiae. Not only this, the party seeking review has also to show 22 RA No. 125/2025 in OA No. 2186/2022 that such additional matter or evidence was not within its knowledge and even after the exercise of due diligence, the same could not be produced before the court earlier." (emphasis added)
22. In the captioned judgment, the term 'mistake or error apparent' has been discussed in the following words:
"22. The term 'mistake or error apparent' by its very connotation signifies an error which is evident per se from the record of the case and does not require detailed examination, scrutiny and elucidation either of the facts or the legal position. If an error is not self-evident and detection thereof requires long debate and process of reasoning, it cannot be treated as an error apparent on the face of the record for the purpose of Order 47 Rule 1 CPC or Section 22(3) (f) of the Act. To put it differently an order or decision or judgment cannot be corrected merely because it is erroneous in law or on the ground that a different view could have been taken by the court/tribunal on a point of fact or law. In any case, while exercising the power of review, the court/tribunal concerned cannot sit in appeal over its judgment/decision". (emphasis added) xxx xxx xxx xxx xxx
25. In Ram Sahu (Dead) Through LRs and Others v. Vinod Kumar Rawat and Others, (2020) SCC Online SC 896, citing previous decisions and expounding on the scope and ambit of Section 114 read with Order XLVII Rule 1, this Court has observed that Section 114 CPC does not lay any conditions precedent for exercising the power of review; and nor does the Section prohibit the Court from exercising its power to review a decision. However, an order can be reviewed by the Court only on the grounds prescribed in Order XLVII Rule 1 CPC. The said power cannot be exercised as an inherent power and nor can appellate power be exercised in the guise of exercising the power of review."
5. We have carefully gone through the order/judgment sought to be reviewed. On perusal of the same, it is apparent that it was admitted case of the parties to the OA that the issue involved in the OA is identical to that in OA No. 671/2003 passed by the Ernakulam Bench of this Tribunal vide order/judgment dated 30.06.2006 and upheld by the Hon'ble High Court of Kerala at Ernakulam vide order/judgment dated 27.03.2012 in WP(C) No. 22276/2007 and on challenge before the Hon'ble Apex Court, CC 23 RA No. 125/2025 in OA No. 2186/2022 No. 1997/2013 was dismissed by the Hon'ble Apex Court vide order/judgment dated 27.03.2012. Admittedly, identical issue came before this Tribunal in OA No. 925/2003 and the Tribunal had dismissed the OA. However, on challenge, the Hon'ble High Court of Patna in Civil Writ Jurisdiction Case No. 11452/2005, set aside the Tribunal's order vide order/judgment dated 09.04.2010. The SLP filed against such judgment of the Hon'ble High Court at Patna, was dismissed by the Hon'ble Apex Court vide order/judgment dated 07.07.2014. It is categorically recorded that judgments of the Hon'ble High Court of Kerala, Hon'ble High Court of Patna and Hon'ble High Court of Delhi referred to in the order/judgment sought to be reviewed are on the same issue as involved in the captioned OA. We have categorically recorded that there is no justification in the stand of the respondents to refuse the grant of identical benefits to the applicants in the present OA as well. Furthermore, even if review application is filed in one of the dismissed SLP and when the judgment of the Hon'ble High Court, the said judgment of the Hon'ble High Court is binding for us.

In view of the aforesaid facts and circumstances, the ground taken by the respondents' that upgraded pay scale granted to the 24 RA No. 125/2025 in OA No. 2186/2022 Accounts Staff in Railways is based on recommendations of the Group of Ministers and the same has not emanated from the recommendations of the 5th Central Pay Commission, is misconceived and irrelevant. Keeping in view the fact that once it has been an admitted fact that the issue has authoritatively been decided by the Hon'ble High Courts, SLP filed against various judgments have since been dismissed and various similarly placed persons in these petitions have already been accorded the benefits as being sought by the original applicants, the plea of the Review Applicants about the recommendation of 5th Central Pay Commission, other repercussions and/or pendency of any Review Application before the Hon'ble Apex Court is found to be of no help to the review applicants.
7. In view of the aforesaid, the present Review Application is found to be bereft of any merit and the same is accordingly dismissed.
