ORAL ORDER
1. Pursuant to the orders passed by this Court dated 04.08.2025 and 21.08.2025, a report has been submitted by the learned President, Industrial Court, Gujarat, stating that the petitioner has tendered an unconditional apology. As per the report of the learned Judge (Senior Division), Labour Court No.2, Bhavnagar, the apology tendered by the petitioner has been accepted.
2. At this stage, this Court would like to refer to the observations made by Justice Krishna Iyer as under:
"Law is meant to serve the living and does not beat its abstract wings in the jural void. Its functional fulfilment as social engineering depends on its sensitized response to situation, subject-matter and the complex of realities which require ordered control. A Holistic understanding is simple justice to the meaning of all legislations. 3. The Bar and the Bench are integral parts of the same mechanism, which administers justice to the people. It is a matter of equal pride and a lawyer should, at all times, pay due respect to the Judge and scrupulously observe the decorum of the Courtroom. It is the reciprocal duty of the Court also to be cognizant of the members of the Bar and to make every endeavor to maintain and protect the respect to which members of the Bar are entitled, both from their clients as well as from the litigant public. The Bar and the Bench are inextricable wings of the judicial forum and therefore, mutual respect is necessary for the efficient functioning of the solemn work carried on in Courts of law.
4. As the learned Judge has observed in the report, the unconditional apology tendered by the petitioner has been accepted. In the considered opinion of this Court, the order passed by the learned Presiding Officer, Labour Court No.2, Bhavnagar, dated 20.01.2025 as well as the order dated 06.03.2025 are required to be set aside and the present petition is deserved to be allowed.
5. Resultantly, this petition is allowed.
