No.2511 of 2020 has been preferred by the appellants for expunging the name of proforma respondent i.e. respondent no.2 namely, Banti, S/o Late S.K. Mohiuddin, R/o Village- Mohanpur, R/o Pachamba, P.O. Pachamba, P.S. & District- Giridih from memo of appeal. Learned counsel for the respondent no.1 has no objection. Considering the same, name of respondent no.2 be expunged from memo of appeal.
Office is directed to delete the same. The aforesaid I.A. stands allowed.
I.A. 7765 of 2016 I.A. No.7765 of 2016 has been preferred by the appellants for condonation of delay of one day in preferring the appeal. It appears that earlier notice has been issued to the respondents in terms of order dated 01.12.2016 by co-ordinate Bench of this Court and pursuant thereto Mr. Sanjay Prasad, learned counsel has appeared on behalf of the respondent no.1.
Learned counsel for the appellants has submitted that there is delay of one day in preferring the appeal, as such, the delay being insignificant may be condoned.
Learned counsel for the respondent no.1 has opposed the prayer. Considering the rival submissions of the parties, delay of one day in preferring the appeal is hereby condoned. The aforesaid I.A. stands allowed.
