05/ 11.01.2018It appears that the petitioner has failed to remove several defects pointed out by the Stamp Reporter for more than a year despite time granted by the Lawazma Board in January 2017. On the other hand, prayer of the writ petitioner was to take steps against the private Respondent for allegedly charging Toll Tax in excess of the prescribed rate from the public.

Learned counsel for the Respondent National Highways Authority submits, on the basis of instructions, that the petitioner has later on withdrawn the complaint through his representation dated 24.12.2016 addressed to the Project Director, NHAI, Dhanbad. She submits that therefore nothing survives in the writ petition. Copy of the representation dated 24.12.2016, produced by the learned counsel for the NHAI, is taken on record.
3. Having regard to the aforesaid facts, we do not find any reason to entertain the writ petition any further. It is accordingly disposed of as such. The concerned authorities of NHAI however would see that such incidences do not reccur in future.
