The petitioner named above has been made accused in connection with Poraiyahat P.S. Case No. 98 of 2021 for the offence under Sections 147 / 149/ 341 / 323/ 332/ 353/ 379/ 504/ 506 of Indian Penal Code and under Rules 4/ 54 of Jharkhand Minor Minerals Concessions Rules, 2004, Section 4(A) of the MMDR Act, 1957 and Rules 9 /13 of the Jharkhand Minerals (Prevention of Illegal Mining, Transportation and Storage) Act, 2017, pending in the court of S.D.J.M., Godda.
It is submitted by learned counsel for the petitioner that as per FIR, the police intercepted and seized one truck loaded with sand which was forcibly released by the unlawful assembly and the petitioner was the member of the said assembly. It is further submitted that no member of the police party was injured and the petitioner is in custody since 24.07.2023.
Learned counsel for the State has opposed the prayer for bail. Considering the facts and circumstances of the case, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each, to the satisfaction of learned Court below.
