8 31-08-2018Today a supplementary counter affidavit has been filed on behalf of respondent nos. 2 and 3 where specific direction has been issued to the University to ensure payment of salary for the period the petitioners have worked within a period of 24 hours.
Mr. Rajesh Kumar Choudhary, learned counsel appearing on behalf of the University submits that University has no adequate fund and the University has requested the State Government to provide fund so that payment is made to the petitioners for the period they have worked. He submits that the amount required for payment is approximately 78 lakhs and Patna High Court CWJC No.12657 of 2017(8) dt.31-08-2018 16/16 odd.
From the letter contained in Annexure-G, it is evident that the Director, Higher Education has written letter to the Registrar of the University to make payment out of whatever fund is available with the University. In the event there is no fund available to the University for payment, the University may raise demand from the State Government enclosing the utilization certificate of the previous fund received by the University so that the State Government may take appropriate decision for allocation of additional fund within a fortnight from the receipt of such request by the University alongwith the copy of utilization certificate of the previous allocation of fund to the University by the State Government.
The Court hope and trust that the State Government as well as the University will ensure payment to the petitioners for the period they have actually worked.
