                                    O R D E R

1. This matter was last heard on 21st of January 2026.

2. On 21st January 2026, this Court passed the following order:-

“1. This matter was taken up for hearing in the first session.
2. After hearing the matter for some time, we felt that we should talk to the parties personally and in such circumstances, in the second session, we took up this matter in the Committee Room.
3. We first had a talk with Shubhank, thereafter with his father Mr. Kailash Chandra Sharma and later with Shilpa and her mother.
4. After talking to the parties for about an hour, we believe that the marriage can still be saved. A little understanding on both the sides is required.
5. All through out the interaction, we kept reminding the parties that they have a minor son who is 6 years of age today.
6. This is a case where the parties fell in love with each other. They started knowing each other 7 years before they decided to get married. They were blessed with a son. Today, we have impressed upon Shubhank to forget the past, bury all the differences and talk to his wife Shilpa and his in-laws.
7. Same way, we have also impressed upon Shilpa and her mother, who are present before us, to give one last chance and Signature Not Verified try to save the marriage only and only in the interest of Digitally signed by VISHAL ANAND Avyaansh. We can understand that both the sides are hurt in Date: 2026.03.13 17:14:29 IST Reason: their own way. Shilpa has her own story to narrate, whereas Shubhank has also his own story to narrate. However, remembering the past is definitely going to be a disaster in so far as marriage is concerned and the upbringing of Avyaansh is concerned.

8. In such circumstances, referred to above, we have impressed upon the parties to keep talking with each other.

Shilpa will share her mobile number with Shubhank and Shubhank will start talking to Shilpa and Avyaansh through video conferencing. If Shilpa wants to share a zoom link or any other video link, Shilpa can talk through that link.

9. The whole purpose of this arrangement is to reduce the tenion and bitterness between the parties, to develop confidence and thereby a ray of hope for both to reconcile. 10 We request Shilpa and her parents to cooperate in giving a meaningful effort to what we have said or rather to the arrangement that we have worked out for the parties. We also request the parents of Shubhank to speak to the parents of Shilpa and Avyaansh.

11. Today, we have made ourselves very clear to Shubhank that whoever may be at fault, it is upto him now to proceed in the right direction and make all endeavours to save the marriage, create that trust once again and start living together as one happy family.

12. Post this matter for further hearing on 11-3-2026 at 3.30 p.m. in the Committee Room.”

3. Today, the matter was taken up for further hearing in the Committee Room.

4. Shilpa is quite firm about her decision to dissolve the marriage. She wants to pursue further with the divorce proceedings. Shubhank is of the firm view that the marriage can be saved and he can live a happy marital life with his wife Shilpa and minor son - Avyaansh.

5. We tried our best to make the parties understand to save the marriage as far as possible in the interest of Avyaansh. Our efforts have failed. In such circumstances, we are left with no other option now but to transfer the proceedings as prayed for. 3

6. Accordingly, the HMA Petition No.578/2024 titled “Shubhank Sharma vs. Smt. Shilpa Shrivastava” filed by the Respondent (husband) under Section 9 of the Hindu Marriage Act, 1955 seeking restitution of conjugal rights, pending before the Principal Judge, Family Court, Raipur, Chhattisgarh is ordered to be transferred to the Principal Judge, Family Court at Bhopal, Madhya Pradedsh. The respondent (husband) is permitted to attend the Trial Court’s proceedngs through online, except on such date/dates, his physical presence is mandatorily required by the Court.

7. However, we make it clear that Shubhank as father will have a right to visit his son Avyaansh twice in a month. Shubhank will inform his wife Shilpa well in advance about his visit to Bhopal. The day Shubhank visits Bhopal, Shilpa and her parents shall cooperate and see to it that Shubhank gets sufficient time to meet and play his son Avyaansh. This arrangement is in the interest of minor Avyaansh.

8. We believe that whatever may be the differences between the husband and wife, child needs equal love, care and affection from his father and mother. Avyaansh should not be deprived of the love and affection of his father. If the paternal grandparents would like to accompany Shubhank to meet Avyaansh, it shall be open for them also to meet Avyaansh. The place of meeting shall be decided and fixed with mutual understanding.

9. We leave it open for Shilpa to initiate appropriate proceedings for her own maintenance as well as for the maintenance of her son Avyaansh before the competent Court. 4

10. If any such application is filed, the Court concerned shall look into it in accordance with law expeditiously.

11. The entire record pertaining to the case shall be transmitted forthwith by the transferor court to the transferee court.

12. With the aforesaid, the Transfer Petition stands disposed of.

13. Pending applications, if any, also stand disposed of.
