Writ Petition No.12663 of 2020
ORDER:-
This writ petition is filed seeking to issue a Writ of Mandamus to declare the inaction of respondent No.4 in not completing the investigation in Crime No.587/2017 on the file of the respondent No.4 as illegal, arbitrary, unconstitutional and consequently direct the respondents particulary, respondent No.4 herein to complete the investigation forthwith in Crime No.587/2017, dated 19-11-2017 within one (1) month.
Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Home.
It is the case of the petitioner that, the crime was registered as Crime No.587/2017 on the file of respondent No.4 for the alleged offences under sections 354A, 354C, 354D, 506, 379, 109 I.P.C on 19-11-2017. Thereafter, the petitioner was remanded to judicial custody illegally for which, a contempt case is pending vide CC No.1277 of 2018 before this Court.
The learned counsel for the petitioner submits that the crime is registered in the year, 2017 and till now, the investigating officer has neither completed the investigation nor filed the chargesheet.
Recording the submissions put forth by both the counsels, this court opines that a duty is cast upon the respondents to conduct the enquiry within a reasonable period and the alleged accused cannot be put to suffer mental agony due to the lapse on the part of the respondents. It is a matter for consideration that the crime was registered in 2017, and so far the investigation is incomplete and no final report filed. 2
Hence, this court deems it fit and proper to direct the respondents to complete the investigation as expeditiously as possible ie, within a period of three (3) months.
With the above direction, the writ petition is disposed of. There shall be no order as to costs.
Consequently, miscellaneous petitions, pending if any, shall stand closed.
