Facts arising from the Complaint:
Mr. Manoj Kumar had filed a RTI application with the PIO, Ministry of Health & Family Welfare, New Delhi on 28/07/2010 asking for certain information. However on not having received the information within the mandated time, the Complainant filed a complaint under Section 18 of the RTI Act with the Commission. On this basis, the Commission issued a notice to the PIO, Ministry of Health & Family Welfare, New Delhi on 07/07/2011 with a direction to provide the information to the Complainant and further sought an explanation for not furnishing the information within the mandated time.
The Commission received a letter dated nil on 17/08/2011 of the Respondent viz. PIO/Director(NRHM) wherein it has been stated that the RTI Application was responded to vide letter 28/07/2010, the same being again sent on 27/07/2011 , copy of both the letters was enclosed. On perusal of the information provided it has been observed that the PIO has stated therein that the matter pertains to the Mission Director of NRHM, Government of Uttar Pradesh. In view of the same, both the Complaint (dated 13/04/2010) with regard to which the Complainant had sought information vide his present RTI Application and the Complainant's first Appeal in this regard has been transferred to the Mission Director of NRHM, Government of Uttar Pradesh for necessary action.
Decision:
The Complaint is disposed off.
In view of the aforesaid the Complainant may pursue the matter with the PIO, O/o the Mission Director of NRHM, Department of Health and Family Welfare, Govt. of Uttar Pradesh and subsequently with the concerned State Information Commission as the jurisdiction of the same falls under the SIC, Uttar Pradesh Notice of this decision be given free of cost to the parties.
