They are heard. Perused the case diary / challan papers. This first application under Section 438 of Criminal Procedure Code, 1973 for grant of anticipatory bail has been filed by the applicant, who is apprehending his / her arrest in connection with Crime No.305/2019 registered at Police Station Maheshwar, District Khargone (MP) for offence punishable under Section 34 (2) of the Madhya Pradesh Excise Act, 1915 and also under Sections 420, 467 and 468 of Indian Penal Code, 1860.
After arguing for some time on the merits of the matter, learned counsel for the applicant seeks leave of this Court for withdrawal of the anticipatory bail application with liberty to the applicant to surrender himself / herself before the Police / trial Court; and file an appropriate application under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail before appropriate Court / trial Court.
Prayer allowed. If such an application is filed before the trial Court, then it shall be decided on its own merits.
With the aforesaid liberty, Miscellaneous Criminal Case No.23620/2020 is dismissed as withdrawn.
