                         BEFORE THE NATIONAL GREEN TRIBUNAL

                                 SOUTHERN ZONE, CHENNAI

                                    O.A.No.274 of 2016 (SZ)

IN THE MATTER OF:

O.A.No.274 of 2016:

S. Joel .. Applicant

                                                      Vs

The Secretary, PWD, Govt. of Tamil Nadu & ors .. Respondents

Date of hearing: 18.2.2020

CORAM:

HON'BLE MR. JUSTICE K. RAMAKRISHNAN, JUDICIAL MEMBER

HON'BLE MR. SAIBAL DASGUPTA, EXPERT MEMBER

For applicant : Nil

For Respondent(s) : . Nil

                                                ORDER

It is seen from the file that the above application was transferred to the Principal Bench where it was renumbered as O.A.348 of 2018 (PB) and the same was disposed of by order dated 17.8.2018 which reads as follows:

"This original application has been filed primarily with the prayer that respondent be directed to continue desilting work of Srivaikundam Anaicut, as per the order passed by the Tribunal on 5.6.2015.
Subsequently, an application came to be filed by some other party before the Southern Bench wherein an interim order had been passed in terms of status quo. It is also to be noted that it was also ordered that detailed plan with modus operandi shall be filed by the next date of 2 hearing. Till then status quo shall be maintained. In other words the interim order passed on 11.8.2016 was only upto the next date, which was 27.9.2016.
Therefore, neither by way of aforesaid interim order nor for any other reason the respondents have been restrained from continuing the desilting. In such circumstances present application filed by the applicant is unwarranted because respondent-State ought to have continued the desilting work for which they have directed by the Tribunal on 5.6.2015.
Consequently, Original Application No.347 of 2018 stands disposed of, with no order as to cost."

Since the above application was already disposed of, there is no necessity for any further orders in this case.
