r to Learned vice counsel for the plaintiff states that he has filed an application under Order 22, Rule 3 of CPC to bring on record the legal heirs of the plaintiff. However, the same is not available on record. Registry is directed to trace the same and place it on record.
The value of the present suit for the purpose of jurisdiction has been assessed at Rs.75,00,000/- (rupees seventy five lakh only).
As per Notification No.HHC/PJ/93-I, dated 17.10.2022 and Corrigendum dated 06.12.2022, Court of District Judge/Additional District Judge shall have the pecuniary jurisdiction in all Original Civil Suits, the value of which does not exceed Rs.1,00,00,000/-(Rupees One Crore).
Since the present suit has been valued by the plaintiff at the rate of Rs. 75,00,000/- as such, the same is transferred to the Court of learned District Judge, Shimla, District Shimla, H.P., who shall dispose of the same in ::: Downloaded on - 16/12/2022 20:39:18 :::CIS accordance with law. The parties are directed to appear before .
the aforesaid Court on 07.03.2023. The records be sent to the said Court, forthwith, so as to reach well before the date fixed.
