% 25.09.2020 HEARD THROUGH VIDEO CONFERENCING.

1. The present appeal has been received on transfer from another Bench. A perusal of the order sheet reveals that based on an early hearing application moved by the appellant (CM APPL. 15541/2020) which was allowed, vide dated 20.07.2020, the appeal was directed to be listed for final arguments today. As the appeal paper book was e-mailed to us late last night, we have not had enough time to peruse the same.

2. In any case, we have indicated to Mr. Rajiv Dutta, learned Senior Advocate appearing for the appellant, Mr. Sanjiv Jha, learned counsel for the respondent and Mr. Ramesh Singh, learned counsel for the applicant seeking impleadment (CM APPL.51983/2018), that having regard to the heavy board, we would not be in a position to take up this appeal for final hearing on a short date. Learned counsel are agreeable to the matter being fixed on a date that may be convenient to the board of this Court.

3. Accordingly, list for arguments on 28.01.2021, in the category of 'After Notice Misc. Matters'.
