Order 11/10/2018 Petitioners, in all these contempt petitions, who are retired employees of Rajasthan State Road Transport Corporation (for short, 'Corporation'), have prayed for taking appropriate action against the contemnor-respondents and punishing them for willful disobedience of the orders passed by this Court in various writ petitions under the Contempt of Courts Act.
After superannuation, when the respondent-Corporation and its officials made no endeavor to pay the petitioners their due retiral benefits, separate writ petitions were filed on their behalf, which were disposed of from time to time by issuing necessary directions to ensure payment of their due retiral benefits. The petitioners have set out a case that despite directions issued by the Court and sending representation/notice for demand of justice, respondents have not paid any heed to their grievances and thereby they have committed blatant contempt of this Court.
Learned counsel, appearing for the respondent- contemnors, very fairly submitted that the representations submitted by the petitioners have been duly considered and compliance of the directions issued by the Court shall be made by the Corporation and its officials in letter and spirit without any demur. Learned counsels, however, submit that at present Corporation is under precarious financial position and therefore (20 of 21) [WCP-152/2018] due to paucity of funds it is not possible to immediately pay due retiral benefits to all the petitioners. It is also contended by learned counsels appearing for the Corporation that delay in payment of retiral benefits to petitioners has occasioned due to non-availability of funds including financial assistance from the State Government in this behalf. Learned counsels further submitted that payment of due retiral benefits will be made to the petitioners as per orders passed in S.B. Civil Writ Petition No.9127/2016 (Ran Singh Vs. Rajasthan State Road Transport Corporation) giving priority as per their date of superannuation. It is also submitted on behalf of respondent-contemnors that the employees, who were superannuated upto 31 st of December 2014, have been paid their retiral benefits by the respondent- contemnors and the petitioners shall also be paid their retiral benefits strictly on priority basis as per date of superannuation on availability of requisite funds.
In view of the submissions made by learned counsels appearing for the respondent-Corporation and its officials and considering perilous fiscal position of the Corporation, all these contempt petitions are disposed of with the expectation that the respondents shall make payment of due retiral benefits to the petitioners strictly on priority basis by considering their date of superannuation.
It is needless to observe that petitioners would also be entitled for interest on the delayed payment of retiral benefits being their legitimate claim. The respondent-Corporation and (21 of 21) [WCP-152/2018] its official contemnors are also expected to make compliance of the direction of the Court issued from time to time with promptitude to mitigate hardships of the petitioners during evening phase of their life. In case respondent and its officials commit any breach of priority in payment of retiral benefits to the superannuated employees or make any attempt to act to their detriment, while making payment of retiral benefits, the aggrieved individual/individuals shall be at liberty to apply for recalling this order and/or renew their prayer afresh.
With these observations, all these contempt petitions are disposed of and the notices are discharged.
