ORDER
1. The complainant, Shri Bijoy Kumar submitted RTI application before the Central Public Information Officer (CPIO), University Grants Commission (UGC), New Delhi seeking duplicate marksheet of first semester bearing enrolment No EIILM.MU/12/F00104 and Roll No. E871650 for the Session July-December, 2012 for the Integrated MBA (BBA+MBA) in Pharmaceutical Management and also sought to know the procedure to obtain the duplicate marksheet.
12. The CPIO, UGC transferred the RTI application to the CPIO, Eastern Institute for Integrated Learning in Management University, Sikkim for providing information directly to the complainant. Not having received any response from EIILM University, the complainant filed an appeal before the FAA.
3. Dissatisfied, the complainant filed the instant complaint before the Commission on the grounds no information had been provided.
4 The matter was heard by the Commission. The complainant stated that he sought duplicate copy of his marksheet of first semester bearing enrolment No EIILM.MU/12/F00104 and Roll No. E871650 for the Session July-December, 2012 for the Integrated MBA (BBA+MBA) in Pharmaceutical Management. The respondents stated that since the information sought related to EIILM University (Private University), Sikkim, the RTI application was forwarded to the University vide letter dated 06.12.2014. They further added that the EIILM University, Sikkim was established by an Act of the State legislature of Sikkim in the year 2006. After receipt of complaints against the University from various quarters and on receipt of a report from the UGC, the State Government of Sikkim closed down the University vide Notification No. 55/DIR(HE)/HRDD dated 30.04.2015 and ceased all the records of the University. Hence, the matter was taken up with the Higher Education Department of the Government of Sikkim. The State Government was requested thrice vide UGC letters dated 05.06.2017, 24.06.2017 and 10.08.2017 to provide the information sought by the complainant. The OSD/SPIO, Higher Education, Human Resource Development Department, Govt. of Sikkim vide letter dated 24.08.2017 address to UGC and copy endorsed to the appellant, informed the UGC regarding providing of duplicate mark sheet of 1st semester to Shri Bojoy Kumar Gogoi bearing Roll No. E871650 that the Integrated MBA (BBA+ MBA) in Pharmaceutical Management course was not a recognized course approved by UGC/DEC. Therefore, they were not in a position to issue duplicate mark-sheet in respect of Shri Bojoy Kumar and the result already issued to him was not valid/ genuine.
25. In view of above submissions of the UGC, the Commission observes that the PIO, Human Resource Development Department, Govt. of Sikkim had responded to the appellant. No action is called for on the part of the Commission. The complaint is closed.
