UPON hearing the counsel the Court made the following

It is the case on behalf of the petitioners that the original writ petitioner is claiming the rights solely on the basis of the Agreement to Sell and that too being the subsequent purchaser.
In that view of the matter and as observed and held by this Court in the case of Shiv Kumar and Another vs. Union of India and others, (2019) 10 SCC 229 as well as Delhi Development Authority vs. Godfrey Phillips (I) Ltd. & Ors. [C.A. No.3073 of 2022 decided on 06.05.2022 and Delhi Administration Thr. Secretary, Land and Signature Not Verified Digitally signed by R Natarajan Date: 2023.04.01 Building Department & Ors. vs. Pawan Kumar & Ors.

of 2022 decided on 06.05.2022], the subsequent purchaser has no locus standi to challenge the deemed lapse of acquisition. 2 Issue notice on the application for condonation of delay as well as on the Special Leave Petition, returnable on 01.05.2023. Dasti, in addition, is permitted.
