paper mills, distillery and slaughter houses and other industries falling in Segment B of phase - I in relation to cleaning of river Ganga pray for time to file the written submission interalia primarily on the following:-
21. Attainment of Zero Liquid Discharge.
2. Installation of online monitoring systems
3. Their present status and the steps they have taken or are willing to take for eradicating industrial pollution resulting from carrying on all these industries.
4. The industry which are operating without consent of the Board or are in violation to the terms and conditions to the consent, if granted, and are having no primary treatment plants and if installed are not using the same in accordance with the prescribed norms and why such should not be directed to be closed down.
Let written submissions be filed within three weeks from today as prayed. We make it clear that we will not grant any further time to any of the industry or association. If the written submissions are not filed they would be deemed to waive their right to file the written submissions.
The copy of the same should be furnished to all the Learned counsel appearing for the parties. Liberty is granted to them to file the objections before the next date of hearing.
Learned counsel appearing for the Uttar Pradesh Pollution Control Board submits that he would file the list of the grossly and seriously polluting industries. Let the same be filed during the course of the day and thus the said list would be put on the website of the Uttar Pradesh 3 Pollution Control Board and the industries may obtain the copy thereof.
There are nearly 1070 seriously polluting industries which include 746 grossly polluting industries. All these industries are represented before the Tribunal through the associations or even individually. We require Pollution Control Board to issue a public notice. Learned counsel appearing for the U.P. Pollution Control Board submits that they have already issued public notice as well as individual notice to all the Noticees which are falling in Segment B of Phase - I either river Ganga or any of its tributaries. Thus such industries and association would be deemed to be served in accordance with law.
We direct MoEF to put on the website the criteria for determination of grossly and seriously polluting industries within one week from today, if not already put.
The industries/associations in their submission should also give the particulars of parameters of their effluent at the inlet of the ETP with respect to water quality parameters of bathing quality water.
Some of the association/industries claimed that representations were made to CPCB, UP Pollution Control Board, Uttarakhand Pollution Control Board. Let those representations be commented by the all the above Pollution Control Boards and such comments will be placed on record before the Tribunal. Copies of the representations be also provided to all three Pollution Control Boards.
