ORAL ORDER
8 22-08-2014As usual the fate of these cases depends on the whims on the learned counsel for the petitioners. The matter when it was placed before the Full Bench a similar prayer for adjournment was made on the ground of non-availability of the Senior counsel for the petitioners. Today when the cases have been taken up the same Patna High Court CWJC No.2162 of 1990 (8) dt.22-08-2014 3 prayer has been made.
It would only reflect that the cases which were filed some 26 years back are not intended to be disposed of even when the main issue has already been decided by the Full Bench of Jharkhand High Court in the case of M/s Lipton India Ltd. v. the State of Bihar, reported in AIR 2004 Jharkhand 34.
Mr. Keshri, learned counsel appearing on behalf of the respondent State in fact would like the matter to be heard but when the counsel for the petitioners wants adjournment in these cases on the ground of non-availability of the Senior counsel, let these cases be listed now in the month of November, 2014.
