Section 13 in The Sugar Development Fund Rules, 1983

13. Business by circulation.

(1)Any business which is not of an urgent nature and which is to be transacted by the Committee or sub-committee, if the Chairman of the Committee or convener of the sub-committees so directs, shall be referred to members by circulation of papers and any proposal so circulated and approved by the majority of the members who have given their approval in writing shall be deemed to be the recommendation of the Committee or the sub-committee as if the proposal had been approved by a majority of the members at a meeting.Provided that at least [five members in the case of the Committee and three members] [Substituted vide GSR 599 dated 30.07.2012.] in the case of a sub-committee have given their approval to the proposal.Provided further that when a proposal is referred to members by circulation of papers, any [five members of the committee or three members] [Substituted vide GSR 599 dated 30.07.2012.] of a sub-committee may require that the proposal be referred to members at a meeting and thereupon such reference shall be made to members at a meeting of the Committee or sub-committee, as the case may be.
(2)When any business is referred to members by circulation, a period of not less than 14 clear days shall be allowed for receipt of replies from members, such period being reckoned from the date on which the said business is so referred by the Secretary to the members.
(3)If any business is transacted by circulation the result thereof shall be communicated to all the members of the Committee or sub-committee by the Secretary of the Committee.
