JUSTICE SABINA Judgment 10/12/2018 Petitioners have filed this petition under Section 438 Code of Criminal Procedure, 1973 seeking anticipatory bail in FIR No.211/2018 registered at Police Station Banipark, Jaipur, for offence under Sections 419, 420, 467, 468, 471, 120-B of Indian Penal Code, 1860.
Learned counsel for the petitioners has submitted that as per the prosecution story, accused had prepared a forged sale deed. However, so far as the petitioners are concerned, they have not signed/thumb marked the sale deed in any capacity. Petitioners have been falsely involved in this case. Petitioners are ready to join investigation.
(2 of 2) [CRLMB-15639/2018] Learned State Counsel, has opposed the petition. Keeping in view the facts and circumstances of the case, it would be just and expedient to order the release of the petitioners on anticipatory bail.
Accordingly, without expressing any opinion on merits of the case, this petition is allowed. In the event of arrest, petitioners be admitted to bail subject to satisfaction of the Arresting Officer. Petitioners shall join investigation as and when required by the police and shall not leave the country without prior permission of the Court. Petitioners shall not tamper with the prosecution evidence.
