PRITAM PAL, J(ORAL):

Petitioners have brought this petition under Section 438 of the Code of Criminal Procedure, for seeking anticipatory bail in case F.I.R. No.38 dated 05.03.2009 under Sections 307/34 of Indian Penal Code and 25/27/54/59 of Arms Act, registered at Police Station Mehta District Amritsar.
Learned State counsel, on instructions of Head Constable Gurminder Singh, has stated that in this case, recovery of weapons has already been effected and now nothing remains to be recovered from any of the petitioners. Further contention of learned State counsel is that they are alleged to have caused fire arm injury on the right leg of Milkha Singh, which was found to be simple in nature. He has fairly stated that none of the petitioner is required for further investigation in this case.
In the given facts and circumstances and without commenting on the merits of this case, petitioners Swinder Singh and Santokh Singh Criminal Misc.No.M-14466 of 2009 (O&M) -2- are allowed to be released on bail in the event of their arrest by the Investigating Officer, subject to the following conditions:-
1. They shall make themselves available for interrogation by a Police Officer as and when required;
2. They shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts to the Court or to any Police Officer;
3. They shall not leave India without the previous permission of the Court.

Criminal Misc. is disposed of.
