1. Learned counsels for the parties submit that the main issue in the present case is whether the suit can continue against Wind World India Ltd., in view of the moratorium having been continued against the same.
2. Mr. Pravin Anand, learned counsel for the plaintiff submits that the suits can continue, as, in terms of Section 14 of the Insolvency and Bankruptcy Code, 2016 ("IBC"), only the assets of the corporate debtors are protected.
3. Per contra, learned counsel appearing for Wind World India Ltd. submits that the scope of Section 14 of IBC, is much larger, with a view to ensure that the Resolution Professional is not inundated with various claims. Thus, he submits that the suits cannot continue.
4. To continue for further arguments, re-notify on 22nd August, 2024.
