                                               ORAL ORDER

1. Ms.Niyati K. Shah, learned counsel for the respondent tenders a copy of the affidavit in support of the settlement, which indicates that the parties have amicably resolved the issue.

2. It deserves to be noted that the order dated 03.05.2016 passed by this Court was subject matter of O.J.Appeal No.11 of 2016. The said appeal is also withdrawn vide order dated 07.06.2016 passed by Division Bench of this Court comprising Hon'ble Mr.Justice S.R.Brahmbhatt and Hon'ble Mr. Justice A.Y.Kogje.

3. Mr.Pratik Acharya, learned counsel for the O.L., who is appointed as Provisional Liquidator, on instructions, makes a statement that the Official Liquidator has not taken possession of any of the property of the respondent Company.

         4.       Mr.Nirav      D.     Trivedi,            learned       counsel          for           the

petitioner, on instructions, states that as the parties have settled the matter outside the Court, the petitioner does not proceed the petition further and intends to withdraw this petition. The petitioner is permitted to withdraw this petition.

In light of the aforesaid, present petition stands disposed of as withdrawn. Appointment of Provisional Liquidator stands discharged.
