Section 48(2) in The Border Security Force Rules, 1969
(2)The witnesses shall give their evidence in the presence of the accused and the accused shall have right to cross-examine all witnesses who give evidence against him:[Provided that where statement of any witness at a Court of inquiry is available, examination of such a witness may be dispensed with and the original copy of the said statement may be taken on record. A copy thereof shall be given to the accused and he shall have the right to cross-examine if he was not afforded an opportunity to cross-examine the witness at the Court of Inquiry.] [Inserted by S.O. 436(E), dated 29.5.1990.]
