The Act of 2012 has been included in the Schedule to the West Bengal Taxation Tribunal Act, 1987 subsequent to the filing of the writ petition.
In view of the Act of 2012 being included in the Schedule to the West Bengal Taxation Tribunal 1987, this Hon'ble Court no longer retains the jurisdiction over the subject writ petition. It would be appropriate to direct the department to transmit the records of this writ petition to the West Bengal Taxation Tribunal.
The department will treat W.P. 7835 (W) of 2016 as disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance of the requisite formalities.
