lt appears that the D._is-trict Collector, Dr. B.R. Ambedkar
Konaseema District issueciI-_:a,~=communication in February, 2023
seeking a change in the alignment on account of the fact that the
earlier alignment was to pass through Amalapuram Towm which had
expanded largely and many business activities had picked up in the
said area. ,.I,,
It was suggested that if.the alignment was allowed, more than

one railway crossing would be required which would cause
discomfort in terms of traffic movement and also delays.
It was also suggested by.,the said District Collector that if there
was no change of alignment, the-,existing National Highway 216 would
require additiomal flyovers i-mpacting the overall project cost. The
flyovers would be required acc®ITding tO him at minimum four points.

As against this, it was suggested that -jf there is a`cha'ng'e` of
alignment, the 'cost of acqui§i{ion in the adjoinil'lg areas' passing
through surrounding vi[Iages` w6tuld be comparatively less.
The issue that is highlig`'hteld in llhe P.I.L js regarding the's[ow
progress in the constructi6fn!'r*r`of--the Kotipa[li -Narsapur Railway
Project, which according to the'' :'petitioners is not attaining finality on
account of lack of contribution by' the State Government which, was to
an extent of 25O/a of the land acquisition cost.
writ petitions also came to be preferred before a single Judge
of this Court seeking a direction against the State authorities not to
change the existing alignment Q.i the railway line.

also the proposed railway alignment only after which a decision

lt is statecl that vide orders dated 23.10.2024 in WP.No.24050 of
2024, a learned single Judge had directed maI-ntenanCe Of Status CIuO

It is therefore prayed that the aforesaid order, dated 23.10.2024,

to see as to whether what was contained in the communication, dated

District, is correct and feasible~: Further cannot be any prohibI-lion On
the respondents from condu_.c±ciJng`'any Survey On the alignment which

It is only after conductingf_£9, Survey, COnSidering the cost factor
of acquisition and the cost already incurrecl on the structures

Railways take a fI-nal Call along,.givith the State au{horI-ties.
lt appears that there is `some understanding between the
Railways and the State Government to share the land acquisition
cost.
Be that as it may, we vacate the interim Orders dated
23.10.2024, 26.10.2024, 05.ll.2024 and 05.ll.2024 passed in
w.p.Mos.24050, 24405, 24960 a 24963 of 2024 respectively. l-h6
official respondents shall be at liberty to conduct the Surve'yS. The
sl,ErveyS be COnduCted a{ the earliest so i.hat the execution Of the
project is undertaken without any further delay. The orcler, dated
