Section 53(1) in Gauhati Municipal Corporation Act, 1971
(1)If at a general election or a subsequent bye-election held to fill a vacancy no Councillor is elected or an insufficient number of Councillor are elected or the election of any or all of the Councillors is set aside under this Act and there is no other candidate or candidates who can be deemed to have been elected in his place or their places, the Commissioner shall fix another day for holding a fresh election and fresh election shall be held accordingly in the prescribed manner.
