5 08-08-2022Cr. Misc. No. 9371 of 2022 Heard learned counsel appearing on behalf of the petitioners and learned APP appearing on behalf of the State.
Let the defect(s), if any, be removed within a period of four weeks from today.
Patna High Court CR. MISC. No.9371 of 2022(5) dt.08-08-2022 2/5 The petitioners seek bail in connection with Dinara (Bhanas O.P.) P.S. Case No. 182 of 2021 registered for the offence under Sections 302 and 201 and 120(B) of Indian Penal Code.
The accused/petitioners are named in the F.I.R., where petitioner no.1 is in custody since 06.10.2021 and petitioner no.2 is in custody since 17.09.2021.
The allegation against the petitioners is to commit murder of husband of the informant, alongwith other co-accused persons, due to previous enmity, where dead body of the deceased was found in the field of one Hari Shankar Pandey.
Learned counsel appearing on behalf of the petitioners submitted that informant is not the eye witness of the occurrence, as per the F.I.R. It is submitted that allegation, as regard to assault causing death of the husband of the informant, is very much general and omnibus. It is submitted that nothing surfaced during the course of investigation, which may incriminate the petitioners with the present set of occurrence and name of the petitioners surfaced in this case only on the basis of suspicion and local village politics. While concluding the argument, it is submitted that investigation in this case is complete for which chargesheet has been submitted, as such, Patna High Court CR. MISC. No.9371 of 2022(5) dt.08-08-2022 3/5 there is no chance of tampering with the evidence.
Learned APP appearing on behalf of the State, while opposing the prayer for bail, fairly conceded that informant is not the eye witness of the occurrence.
In view of the facts and circumstances, as mentioned above, as informant is not the eye witness of the occurrence, where nothing surfaced during the course of investigation, which may connect the petitioners, prima facie, with the alleged set of occurrence coupled with the fact that chargesheet has already been submitted, let the petitioners, above named, are directed to be released on bail in connection with Dinara (Bhanas O.P.) P.S. Case No. 182 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-IX, Sasaram, Rohtas, subject to the conditions as laid down u/s 437(3) of the Cr.P.C.

While concluding the argument, it is submitted that investigation in this case is complete for which chargesheet has been submitted, as such, there is no chance of tampering with the evidence.
