sanjay ct. no.40 CRR No.3806 of 2017 In the matter of : Sk. Shah Jamal ..... Petitioner.

                 None appears. ...for the petitioner.

                 Mr. Arijit Ganguly,
Mr. Avik Ghatak ...for the State.

None appears for the petitioner. The instant revisional application has been filed for expeditious disposal of Amta Police Station Case No. 77 of 2014 dated 03.03.2014 under Sections 448/188/506/427/34 of the Indian Penal Code, 1860.

From the order sheets enclosed along with the revisional application it is reflected that on 15.10.2014 learned Additional Chief Judicial Magistrate, Uluberia on perusal of the charge-sheet was pleased to take cognizance and issue summons against all the accused persons therein. Pursuant to the same on one pretext or the other the proceedings were delayed. However, by an order dated 03.07.2017 learned Additional Chief Judicial Magistrate, Uluberia was pleased to fix on 12.3.2018 for appearance and copy.

In the meantime on 14.09.2017 the defacto-complainant (the petitioner herein) filed an application for framing of 2 charge when learned Additional Chief Judicial Magistrate was pleased to fix such petition for hearing on 12.03.2018.

I find from the order sheet that since submission of charge-sheet in the year 2014 on one pretext or the other dates have been fixed without any effective progress in the proceedings. As the police station case is more than five years old, the grievance of the petitioner/defacto-complainant is not unjustified. However, present stage of the proceedings before the learned Additional Chief Judicial Magistrate has not been brought to the notice of this Court when the matter has been taken up.

In the absence of the same this Court directs the learned Additional Chief Judicial Magistrate, Uluberia to take necessary steps for progress of the case and take it to its logical conclusion as expeditious as possible.

With the aforesaid observations, CRR 3806 of 2017 is disposed of without any order as to costs.
