CRL.M.C. 1282/2025 & CRL.M.A. 5729/2025 (stay)

1. The instant petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (earlier Section 482 of the Code of Criminal Procedure, 1973) has been filed on behalf of the petitioner for the following reliefs:

a) Quash the complaint titled "Employees Provident Fund Organisation vs. Technip India Limited and ORS" bearing CT No. 1131/2022 pending in the Court of Metropolitan Magistrate-01, Shahdara Karkardooma Courts, Delhi.;
b) Quash the summoning order dated 21/01/2023 in the complaint titled "Employees Provident Fund Organization Vs. M/s Technip India Limited and Ors" bearing CT No. 1131/2022 passed by the court of Metropolitan Magistrate-01, Shahdara Karkardooma Courts, Delhi.; and This is a digitally signed order.

c) Pass any such other/further petition of any nature, direction, order as this Hon'ble Court may deem fit in the facts and circumstances of the present case.

2. Heard.

3. Issue notice. Learned counsel for the respondent No.1 appearing on advance notice accepted notice and vehemently opposed the instant petition. He prayed for four weeks' time to file the reply. Let the same be filed within the time as prayed for. Rejoinder thereto, if any, be filed within two weeks' thereafter.

4. Issue notice to respondent no. 2 through all permissible modes on filing PF within one week.

5. Learned counsel for the petitioner submitted that the entire dues have been paid by the petitioner and prayed that proceedings before the concerned Court below be stayed.

6. Learned counsel for the respondent No.1 does not have any objection to the said fact stated on behalf of the petitioner regarding the payment of entire dues.

7. Therefore, taking into consideration of the submissions advanced on behalf of the parties and the fact that the entire dues were paid by the petitioner, which was not objected to by the learned counsel for the respondent No.1, this court is of the considered view that the proceedings before the concerned Court below be kept in abeyance till further orders.

8. List on 1st May, 2025 along with Crl.M.C.1242/2025.
