It has been submitted by Mr. Anil Khanna, learned counsel appearing for the respondents that the writ petition had been filed by the petitioners against the rejection of his application for being impleaded as party to the proceedings pending before the J.D.A. Appellate Tribunal and the J.D.A. Appellate Tribunal has already decided the appeal. Since, no proceedings are pending before the Tribunal question of impleading the petitioners as party does not arise. There appears to be substance in the submission of the learned counsel for the respondents.

In view of the above, the writ petition has become infructuous and the same is, accordingly, dismissed as having become infructuous.

In case, the petitioners are aggrieved by the ultimate order that is passed by the learned Tribunal the petitioners would be at liberty, independent of these proceedings to seek recourse to the remedy available under the law.

The writ petition is, accordingly, disposed of as having become infructuous.
