Section 11(b) in The Jammu and Kashmir Common Lands (Regulation) Act, 1956
(b)no person shall, except as provided in this Act, take possession of or otherwise encroach upon any land vacant at the commencement of this Act other than that used as a courtyard or compound of a house, a vegetable garden, a Sagzar or a Wari, which is included in the Abadi-Deh of any village.
