% 01.12.2023 I.A.16301/2021 (under Section 34(3) of the Arbitration and Conciliation Act, 1996 on behalf of the petitioner seeking Condonation of Delay of 28 days in filing the petition)

1. An application has been filed on behalf of the petitioner seeking Condonation of Delay of 28 days in filing the present petition under Section 34 of the Arbitration and Conciliation Act, 1996 (hereinafter referred to as "the Act").

2. The log information discloses that the petition under Section 34 of the Act was filed on 16.09.2019 against the Award dated 29.01.2019, copy of which was received by the petitioner on 21.08.2019, and the defects noted were that it was filed "without book marking and without pagination".

3. Inherently, no effects had been noticed which would make the filing nonest. Hence, the date of institution of the objections is taken as 16.09.2019 which is beyond the period of three months but within a period This is a digitally signed order.

5. For the reasons stated, the application is allowed and is accordingly disposed of.
