Order ORDER No. 03.02.2025
01. 1. The petitioners have challenged the order dated 06.11.2024 passed in connection with Puri Sadar P.S. Case No.1/1998 corresponding to S.T. Case No.46/313 of 2013/2003 arising out of G.R. case No.15 of 1998 for commission of the offences punishable under Sections 147/ 148/ 341/ 323/ 325/380/307/149 of the IPC r/w Section 9(b) of the I.E. Act r/w Sections 25 & 27 of the Arms Act, pending in the Court of the learned 3rd Additional District Judge, Puri, by which the N.B.W. has been issued against them.
2. Learned counsel for the petitioners submits that Page 1 of 2 the petitioners were on bail, however, they could not appear before the learned Court below leading to issuance of the N.B.W. against them on 06.11.2024.
3. Learned counsel for the petitioners, on instruction, submits that, the petitioners would surrender/appear before the learned Court below on or before 05.03.2025 and seek remedy available to them under law.
4. On the basis of the aforementioned facts and submissions made at the Bar, the order dated 06.11.2024 passed in connection with Puri Sadar P.S. Case No.1/1998 corresponding to S.T. Case No.313 of 2003 arising out of G.R. case No.15 of 1998, pending in the Court of the learned 3rd Additional District Judge, Puri, is set aside, subject to the petitioners surrendering before the Court below on or before 05.03.2025 and depositing cost of Rs.500/- (Rupees five hundred) each with District Bar Association, Puri. Liberty is granted to the petitioners to avail remedy under law after surrendering as per the undertaking.
5. The CRLMC is accordingly disposed of.
