Rakib (Rejected) CRM (NDPS) 1529 of 2025 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with F. No. - S1(VII)- 216 of 2025 (AIU) dated 18.09.2025 under Sections 20(B)(ii)(B)/23(a) read with 8 of the of the Narcotic Drugs and Psychotropic Substances Act, 1985.
And In the matter of : Shahzada Hussain.
......Petitioner.
Mr. Debasis Kar ......for the Petitioner.
Mr. Uday Shankar Bhattacharya Ms. Sretapa Sinha ......for the Customs Authorities. Learned advocate appearing for the petitioner submits that the petitioner is in custody for four months and from whom allegedly 1 kg 99 grams of ganja were recovered. Learned advocate submits that petitioner is innocent of the charges and has been falsely implicated and was not conscious regarding the possession.
On the other hand learned advocate for the Customs Authorities opposes the prayer for bail and submits that the interception was at the Airport. Petitioner was in conscious condition and was importing contraband from a foreign country.
Having regard to the fact that the Calcutta Airport is being used as a corridor by unscrupulous carriers for importing contraband, I am not inclined to grant bail to the petitioner.
Accordingly, the prayer for bail of the petitioner in CRM (NDPS) 1529 of 2025 is dismissed.
2Learned trial Court will expedite the process of trial by fixing at least a schedule in a month for taking the trial to its logical conclusion.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
