1. The present appeals have been listed after being circulated in the supplementary list as it was pointed out that the order dated 18.10.2024 inadvertently recorded the next date as 25.11.2024 as against the date of 25.10.2024, for which date, the appeals were actually adjourned. Since learned counsel for both sides are present, the appeals are being taken up for consideration today.
2. Pursuant to the last order, the respondents have handed over an affidavit alongwith a copy of the proposed schedule formulated by the Electoral Officer for holding the Annual General Meeting (AGM) and the elections. The said affidavit is taken on record.
3. The proposed schedule formulated by the Electoral Officer has been perused and though this Court finds the said schedule to be satisfactory, taking into account the large number of members of respondent no.1/association who are likely to participate in the elections, it is deemed appropriate that polling should take place on weekend. We, accordingly, direct that while the remaining dates as proposed by the Electoral Officer will stand unchanged, the AGM and polling will take place between 13.12.2024 to 15.12.2024 as against the dates proposed by him and consequently, the results will be declared on 16.12.2024 instead of 13.12.2024 as initially proposed.
