	Petition filed under Article 226 of the Constitution of India for the issuance of writ of Certiorarified Mandamus, calling for the records pertaining to the impugned order made in Na.Ka.No.P2/2091/2014, dated 06.05.2015 (served on 12.06.2015) passed by the 2nd respondent, quash the same and consequently direct the respondents to act in compliance with the undertaking recorded in the order dated 12.12.2012 made in W.P.No.13387 of 2005.

O R D E R

The petitioner has come up with this writ petition to quash the impugned order of recovery, dated 06.05.2015 passed by the second respondent and for a direction to the respondents to act in compliance with the undertaking recorded in the order dated 12.12.2012 made in W.P.No.13387 of 2005.

2. When the matter is taken up for hearing, the learned Special Government Pleader for the respondents would submit that as against the impugned order of recovery, dated 06.05.2015, appeal remedy is available to the petitioner.

3. In view of the submission made by the learned Special Government Pleader, the writ petition is disposed of permitting the petitioner to file appeal to the first respondent, within a period of two weeks from today and if any such appeal is filed, the first respondent is directed to dispose of the same, within a period of eight weeks thereafter. Till the disposal of the appeal, no recovery shall be made. No costs.
