1 Ms. Rachure, counsel for defendant no.1 states that defendant no.1 had taken out a notice of motion no.1215 of 2019 to recall an order dated 18th July 2018 and 8th August 2018 and that notice of motion is yet to be heard. By the said orders, defendants' evidence was closed. 2 Mr. Dave states that on 27th June 2019, the said notice of motion was dismissed as none appeared for defendant no.1. Ms. Rachure states that on 27th June 2019 she was in some personal difficulty and had infact filed a leave note in the Appellate Side only because the Original Side has stopped accepting leave notes. Ms. Rachure prays that the order dismissing the notice of motion passed on 27th June 2019 be recalled. In view of what is stated by Ms. Rachure, Mr. Dave has no objection. 3 Therefore, the order dated 27th June 2019 dismissing the notice of motion no.1215 of 2019 is recalled.
