I.A.No.6478 of 2009 has been filed on behalf of the petitioner on 14.10.2009 for expunging the name of opposite party no.40 Jogmaya alias Yogmaya Devi who is said to have died on 16.12.2003 leaving behind her heirs and legal representatives who are already on record of this case as opposite parties no.8, 9 and 10.

In the said circumstances, this interlocutory application is allowed. Let the name of opposite party no.40 be expunged at the risk of the petitioner.
