1. Mr. Naresh Chandra Das, opposite party no.2 (informant) appears in person on virtual mode from the virtual High Court, Kendrapara. He is identified by Mr. Biswajit Mohapatra, learned counsel who is present in Court today. Mr. Das submits that he had lodged FIR due to a misunderstanding over a trivial incident. The matter has been amicably settled in the meanwhile and he does not want to proceed with the case for which he has no objection if the case is quashed.

2. Mr. H.M. Dhal, learned Additional Government Advocate files the instructions dated 19.05.2023 received from the IIC, Town P.S., Kendrapara wherein it has been stated that chargesheet had been submitted in Kendrapara Town P.S. No. 147 of 2022 under Sections 341/ 323/ 294/ 506 and 34 of I.P.C. But on verification, he has learnt from the complainant that the matter has been amicably settled between the complainant and the accused and the decision of the complainant not to proceed further in the case is without any threat or pressure. The said instructions are taken on the record.

3. Considering the above submissions, the order dated 04.01.2023 passed by the learned S.D.J.M, Kendrapara in G.R. Case No. 1786 of // 2 // 2022 and which corresponds to Kendrapara Town P.S. Case No. 147 of 2022 and further proceedings in the case are quashed.

4. Urgent certified copy of this order be granted on proper application.

5. A copy of this order be sent to the court of the learned S.D.J.M., Kendrapara.
