ORDER
As pointed out in the earlier Order, the issue which is the subject matter of this Appeal is the same in Appeal No. 134 of 2009 also. In that view of the matter, Mr. M.G. Ramachandran seeks permission of this Tribunal to withdraw this Appeal.
Accordingly, the Appeal is dismissed as withdrawn without prejudice to the rights of the Appellant to urge the point of issue which is raised in Appeal No. 134 of 2009.
